Introduction
This Terms of Service Agreement made between LMNGreen, online service of the first part and You of the second part is subject to these terms, without prejudice to any additional terms which may be part of an agreement specific to the service you wish to avail of. Your agreement with LMNGreen will always include, at a minimum, the terms and conditions set out in this document.
LMNGreen does not sell its own products or services but merely acts as a platform to other service - providers.
You must be at least 18 years of age to use this website.  By using this website and by agreeing to these terms and conditions you warrant and represent that you are at least 18 years of age.
This website uses cookies.  By using this website and agreeing to these terms and conditions, you consent to our LMNGreen use of cookies in accordance with the terms of LMNGreen privacy policy / cookies policy.
This website is provided “as is” without any representations or warranties, express or implied.  LMNGREEN makes no representations or warranties in relation to this website or the information and materials provided on this website. All commercial/contractual terms are offered by and agreed to between Buyers and Sellers alone. The commercial/contractual terms include without limitation price, shipping costs, payment methods, payment terms, date, period and mode of delivery, warranties related to products and services and after sales services related to products and services. LMNGreen does not have any control or does not determine or advise or in any way involve itself in the offering or acceptance of such commercial/contractual terms between the Buyers and Sellers. All discounts, offers (including exchange offers) are by the Seller/Brand and not by LMNGreen
LMNGreen is not responsible for any non-performance or breach of any contract entered into between Buyers and Sellers. LMNGreen cannot and does not guarantee that the concerned Buyers and/or Sellers will perform any transaction concluded on the Platform. LMNGreen shall not and is not required to mediate or resolve any dispute or disagreement between Buyers and Sellers.
The Platform is only a platform that can be utilized by Users to reach a larger base to buy and sell products or services. LMNGreen is only providing a platform for communication and it is agreed that the contract for sale of any of the products or services shall be a strictly bipartite contract between the Seller and the Buyer.LMNGreen, currently, does not facilitate business to business transaction between Sellers and business customers
Without prejudice to the generality of the foregoing paragraph, LMNGreen does not warrant that:
this website will be constantly available, or available at all; or
the information on this website is complete, true, accurate or non-misleading.
 Nothing on this website constitutes, or is meant to constitute, advice of any kind.  [If you require advice in relation to any [legal, financial or medical] matter you should consult an appropriate professional.

 Limitations of liability
 LMNGREEN will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this website:
to the extent that the website is provided free-of-charge, for any direct loss;
for any indirect, special or consequential loss; or
for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.
 These limitations of liability apply even if LMNGreen has been expressly advised of the potential loss.
 Exceptions
 Nothing in this website disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in this website disclaimer will exclude or limit LMNGreen's liability in respect of any:
death or personal injury caused by LMNGreen's negligence;
fraud or fraudulent misrepresentation on the part of LMNGreen; or
matter which it would be illegal or unlawful for LMNGREEN to exclude or limit, or to attempt or purport to exclude or limit, its liability.

LMNGREEN will allow the user to buy product using the following forms of payments.

--> Debit Cards
--> LMNGreen vouchers
--> any other mode of payment, as may be decided and made available on the Platform.
Please note that payment can be made only in India Rupees and all the above payment instruments must have been issued by entities operating in India and subject to Indian regulations.
 
EXCLUSION OF WARRANTIES
10.1 YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE OFFERING IS AT YOUR SOLE RISK AND THAT THE OFFERING ARE PROVIDED AS IS AND AS AVAILABLE.
10.2 IN PARTICULAR, LMNGREEN DOES NOT REPRESENT OR WARRANT TO YOU THAT:

(A) YOUR USE OF THE OFFERING WILL MEET YOUR REQUIREMENTS.

(B) YOUR USE OF THE OFFERING WILL BE UNINTERRUPTED, TIMELY, SECURE OR FREE FROM ERROR, INCLUDING SPECIFICALLY FROM SERVER DOWNTIME.

(C) ANY INFORMATION OBTAINED BY YOU AS A RESULT OF YOUR USE OF THE OFFERING WILL BE ACCURATE OR RELIABLE.
10.3 ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE OFFERING IS DONE AT YOUR OWN DISCRETION AND RISK AND LMNGREEN WILL NOT BE RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR OTHER DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
10.4 NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM LMNGREEN OR THROUGH OR FROM THE OFFERING SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS.
10.5 LMNGREEN FURTHER EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
11. LIMITATION OF LIABILITY
11.1 NOTWITHSTANDING ANYTHING IN THIS AGREEMENT, YOU EXPRESSLY UNDERSTAND AND AGREE THAT LMNGREEN SHALL NOT BE LIABLE TO YOU FOR:

(A) ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES WHICH MAY BE INCURRED BY YOU, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY. THIS SHALL INCLUDE, BUT NOT BE LIMITED TO, ANY LOSS OF PROFIT (WHETHER INCURRED DIRECTLY OR INDIRECTLY), ANY LOSS OF GOODWILL OR BUSINESS REPUTATION, ANY LOSS OF DATA SUFFERED, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR OFFERING, OR OTHER INTANGIBLE LOSS.

(B) ANY LOSS OR DAMAGE WHICH MAY BE INCURRED BY YOU, INCLUDING BUT NOT LIMITED TO LOSS OR DAMAGE AS A RESULT OF:

(i) ANY CHANGES WHICH LMNGREEN MAY MAKE TO THE OFFERING, OR FOR ANY PERMANENT OR TEMPORARY CESSATION IN THE PROVISION OF THE OFFERING (OR ANY FEATURES WITHIN THE OFFERING).

(ii) THE DELETION OF, CORRUPTION OF, OR FAILURE TO STORE, ANY CONTENT AND OTHER COMMUNICATIONS DATA MAINTAINED OR TRANSMITTED BY OR THROUGH YOUR USE OF THE OFFERING.

(iii) YOUR FAILURE TO PROVIDE LMNGREEN WITH ACCURATE ACCOUNT INFORMATION.

(iv) YOUR FAILURE TO KEEP YOUR PASSWORD OR ACCOUNT DETAILS SECURE AND CONFIDENTIAL.
12. Other content to which references are made, links are provided, etc.
12.1 The offering may include hyperlinks to other web sites or content or resources. LMNGREEN may have no control over any web sites or resources which are provided by companies or persons other than LMNGreen.
12.2 You acknowledge and agree that LMNGreen is not responsible for the availability of any such external sites or resources, and does not endorse any advertising, products or other materials on or available from such web sites or resources.
12.3 You acknowledge and agree that LMNGreen is not liable for any loss or damage which may be incurred by you as a result of the availability of those external sites or resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, such web sites or resources.
13. Changes to the Terms
13.1 LMNGreen may make changes to the terms from time to time. The same will be communicated to you, on the website, without prior intimation to you. Your continued use of the offering will indicate your acceptance of the modified terms. When these changes are made, LMNGREEN shall make the amended copy of the terms available in an accessible location.
13.2 You understand and agree that if you use the offering after the date on which the terms have changed, or after the date by which you have to respond as per these terms has passed, LMNGreen will treat your use as acceptance of the amended terms.
14. General legal terms
14.1 Sometimes when you use the offering, you may (as a result of, or through your use of the offering) use a service or download a piece of software, or purchase goods, which are provided by another person or company. Your use of these other offering, software or goods may be subject to separate terms between you and the company or person concerned.
14.2 The terms constitute the legal agreement between you and LMNGreen and govern your use of the offering, but without prejudice to any additional terms which may be part of an agreement specific to the service you wish to avail of. (but excluding any offering which LMNGREEN may provide to you under a separate written agreement), and completely replace any prior agreements between you and LMNGreen in relation to the offering.
14.3 You agree that if LMNGREEN does not exercise or enforce any legal right or remedy which is contained in the terms (or which LMNGreen has the benefit of under any applicable law), this will not be taken to be a formal waiver of s rights and that those rights or remedies will still be available to LMNGreen.
14.4 If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these terms is invalid, then that provision will be removed from the terms without affecting the rest of the terms. The remaining provisions of the terms will continue to be valid and enforceable.
14.5 The terms, and your relationship with LMNGreen under the terms, shall be governed by the laws of India. You and LMNGreenagree that any dispute will be referred to arbitration, with the arbitral panel consisting of three arbitrators, one arbitrator being chosen by each party and a third being jointly appointed by the two arbitrators so chosen.
14.6 We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.
 
Law and jurisdiction
These terms and conditions will be governed by and construed in accordance with [GOVERNING LAW], and any disputes relating to these terms and conditions will be subject to the [non-]exclusive jurisdiction of the Bangalore High Court.
